Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the website at bobvan.com, the Bob Van customer dashboard, and the embeddable lead-generation tools and widgets we provide, including QuickQuote (collectively, the "Services"). The Services are operated by Bryan Wheeler ("Bob Van," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Bob Van provides software that lets businesses add quote, estimate, and lead-capture widgets to their websites, collect and manage the resulting leads, and optionally route those leads to third-party tools the business connects. Features, products, and plans may change over time.

You must provide accurate information when you create an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 18 years old and able to form a binding contract. Accounts are intended for business use.

We offer a free plan with usage limits and may offer paid plans with additional features and higher limits. Plan limits, including the number of widgets and monthly lead volume, are described in the Services and may be adjusted. If and when paid plans are enabled, fees are billed in advance through our payment processor, are stated exclusive of taxes, and are non-refundable except where required by law. You may cancel at any time, and cancellation takes effect at the end of the current billing period. We may change pricing on a going-forward basis with notice.

You are solely responsible for the widgets you configure, the questions you ask, the data you collect, and your use of that data. You represent that you have all necessary rights and consents to collect and process the information your widgets gather, and that you will comply with all applicable laws, including those governing privacy, marketing, telephone and text-message contact, and email.

Estimates are not binding quotes. Prices and ranges shown by QuickQuote and similar tools are ballpark estimates generated from the inputs and pricing rules configured. They are informational only, do not constitute an offer or a binding quote, and may differ from final pricing. You are responsible for the accuracy of any pricing rules you configure.

The Services let you connect third-party destinations and providers, such as field-service platforms (for example Sweep & Go), webhooks, spreadsheets, and CRMs. When you connect an integration, you authorize Bob Van to send the relevant lead and quote data to that destination on your behalf. Your use of third-party services is governed by their terms and privacy policies. We are not responsible for third-party services, their availability, or how they handle data, and you represent that you are authorized to connect them.

You agree not to: use the Services for unlawful, deceptive, or harmful purposes; send unsolicited messages or violate anti-spam or telemarketing laws; collect sensitive data without a lawful basis; infringe intellectual property or privacy rights; attempt to access another account's data; probe, scan, or breach security or rate limits; introduce malware; scrape or overload the Services; or resell or sublicense the Services without our written permission.

As between you and Bob Van, you own the leads, configuration, and content you submit or collect through the Services ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data as necessary to provide and improve the Services and to comply with law. Our handling of personal information is described in our Privacy Policy.

The Services, including the Bob Van name, logos, widget engine, software, and design, are owned by Bob Van and protected by intellectual property laws. Except for the rights expressly granted to you to use the Services, no rights are transferred to you.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. Nothing in the Services is legal, financial, tax, or professional advice.

To the maximum extent permitted by law, Bob Van will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (USD 100).

You will defend, indemnify, and hold harmless Bob Van from any claims, damages, and expenses arising out of your use of the Services, your Customer Data, your widgets, your communications with your end-users, your connected integrations, or your violation of these Terms or applicable law.

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Services or other users. On termination, your right to use the Services ends; provisions that by their nature should survive will survive, including ownership, disclaimers, limitation of liability, and indemnification.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes will be communicated where appropriate. Your continued use of the Services after an update means you accept the revised Terms.

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Arizona for any dispute not subject to other agreed dispute-resolution terms.
